(1) That if the rent hereby reserved or any part thereof shall be Power of unpaid for twenty-one days after becoming payable (whether formally demanded or not) or if any covenant on the Lessee's part herein contained shall not be performed or observed or if the Lessee shall become bankrupt or make any assignment for the benefit of his creditors or make any arrangement with his creditors for liquidation of his debts by composition or otherwise or suffer execution to be levied on his goods or if the Lessee for the time being is a company and shall be wound-up either compulsorily or voluntarily (except for the purpose of reconstruction or amalgamation) then and in any of the said cases it shall be lawful for His said Majesty by the Governor or other person duly authorized in that behalf into and upon the said premises or any part thereof in the name of the whole to re-enter and thereupon this demise shall absolutely determine but without prejudice to the right of action of His said Majesty in respect of any arrears of rent or any breach of the Lessee's covenants herein contained.
(2) That His said Majesty shall have full power to resume enter into and re-take possession of the said pier or any part thereof if required for the improvement of the said Colony or for any other public purposes whatsoever three calendar months' notice being given to the Lessee of its being so required and a full and fair compensation therefor being paid to the Lessee at a valuation to be fairly and impartially made by the Director and upon the exercise of such power the term hereby created shall in respect of the premises resumed cease determine and be void.
(3) That the Lessee duly performing and observing the covenants on his part to be performed and observed shall on the expiration of the term hereby granted be entitled to a further Lease of the said pier for the term of FIFTEEN YEARS terminating on the thirty-first day of December One thousand nine hundred and seventy-nine without payment of any fine or premium in respect of the further term but at a re-assessed rent as
